The legality of CBD oil depends largely on where it specifically comes from and how it is intended to be used.
In the USA, a distinction is made between cannabis indica and the so-called industrial hemp. The latter, as defined by federal law, contain a lower concentration of THC, roughly below 0.3%. On the other hand, cannabis indica with concentration larger than 0.3% is called marijuana and is a typically intoxicating product.
Products with CBD, including oils, that contain less than 0.3% THC, are legal in the US, while those with THC concentrations above 0.3% are illegal.
However, each state has its own laws regarding the consumption of CBD oil. For example, Washington state law allows for the legal consumption of CBD oil for recreational purposes. Dakota state law, on the other hand, classifies the CBD chemical compound as a controlled substance and only allows for its consumption in forms that are approved by the Food and Drug Administration.
